By accessing and using TopAIPrompts ("the Platform"), operated by I Systems ("we," "us," or "our"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Platform.

2. Description of Service

TopAIPrompts is an online store that sells AI prompt packs and templates created by TopAIPrompts. All prompts on the Platform are written, owned, and sold directly by us; we do not sell products on behalf of any third party. The Platform allows users to browse and purchase prompts designed for use with AI tools such as ChatGPT, Claude, Midjourney, and others. We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

3. User Accounts

To access certain features, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Providing accurate, current, and complete information during registration
• Promptly notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Intellectual Property & Prompt Ownership

When you purchase a prompt from TopAIPrompts, you are granted a non-exclusive, non-transferable licence to use that prompt for personal or commercial purposes, unless otherwise stated. You may not:

• Resell, redistribute, or sublicense purchased prompts without written permission
• Claim ownership of any prompt available on the Platform
• Reverse-engineer or extract underlying methodologies from purchased prompts

All prompts, templates, and related content on the Platform are created by and remain the intellectual property of I Systems. Purchasing a prompt grants you a licence to use it as described above; it does not transfer ownership.

5. User Conduct

You agree not to use the Platform to:

• Share or publish content obtained from the Platform in a way that is unlawful, harmful, defamatory, or obscene
• Generate or distribute prompts intended to facilitate illegal activity
• Impersonate any person or entity or misrepresent your affiliation
• Engage in scraping, data mining, or unauthorized automated access
• Circumvent any security or access controls on the Platform
• Upload malicious code, viruses, or any software designed to harm the Platform or its users

6. Payment Terms

Some prompts and features on TopAIPrompts require payment. By making a purchase, you agree that:

• Refunds are available only as described in our Refund Policy (Section 7)
• You are responsible for all applicable taxes, unless they are collected at checkout
• Payment is processed securely by our payment partners (for example, Razorpay for customers in India)
• We do not store your full payment card details

If you believe you have been charged in error, please contact us within 14 days of the transaction.

7. Refund Policy

Our goal is to ensure customer satisfaction with the prompts purchased from TopAIPrompts. Refunds will be granted solely in cases where the prompt does not work as described. To be eligible for a refund, you must submit a request within 7 days of your purchase, providing a clear explanation and evidence demonstrating that the prompt is not functioning as described. Upon reviewing your request, we will determine, at our sole discretion, whether your claim is valid and, if so, issue a refund. Refunds will be processed within 5-10 business days after receiving your request.

8. AI-Generated Content Disclaimer

Prompts on TopAIPrompts are intended to guide AI tools. We do not guarantee the accuracy, reliability, or fitness for a particular purpose of any AI-generated output produced using our prompts. Users are solely responsible for reviewing and validating AI outputs before use in professional, financial, legal, medical, or other contexts.

9. Limitation of Liability

To the fullest extent permitted by applicable law, I Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Platform
• Any content obtained through the Platform
• Unauthorized access to or alteration of your data
• Results produced by AI models using our prompts

10. Indemnification

You agree to indemnify, defend, and hold harmless I Systems and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
